Ken Ofori-Atta ICE detention: Ghana’s Ambassador to the United States of America, Victor Emmanuel Smith, has revealed that former Finance Minister Ken Ofori-Atta is apprehensive about returning to Ghana, citing concerns over how he may be treated upon arrival.

Speaking on TV3’s The KeyPoints programme on January 17, Ambassador Smith disclosed that Ofori-Atta’s fears were communicated to him through a phone conversation with the former minister’s cousin, Gabby Asare Otchere-Darko.

“Gabby called me and said Ken wants to come but he is afraid of how he will be treated,” Ambassador Smith stated.

According to the Ambassador, Ofori-Atta’s concerns stem from the intense political and legal controversy surrounding the corruption and corruption-related charges he faces in Ghana. These charges are currently being pursued by the Office of the Special Prosecutor (OSP).

Ken Ofori-Atta ICE detention: Assurance of Due Process

Ambassador Smith noted that following the call, he expressed a desire to personally meet with the former Finance Minister to reassure him of a fair legal process should he decide to return home.

“So I told him I wanted to meet Ken and give him the assurance that he will be taken through the legal process, because the Attorney-General, Dr. Ayine, gave me that assurance,” he explained.

The statement comes amid growing public debate over whether Ghana’s justice system can guarantee impartiality in high-profile corruption cases involving former government officials.

ICE Labels Ofori-Atta an “Illegal Alien”

Meanwhile, the United States Immigration and Customs Enforcement (ICE) has officially described Kenneth Nana Yaw Ofori-Atta as an “illegal alien” who overstayed his permitted admission into the United States.

This clarification was provided by an ICE spokesperson in a correspondence with TV3 journalist Joseph Ackah-Blay, who contacted the agency to seek clarity on the circumstances surrounding the former Finance Minister’s detention.

ICE stated that Ofori-Atta’s continued stay in the United States violates U.S. immigration law and could potentially result in deportation.

Questions Surrounding the Arrest

Following widespread speculation about the reasons for Ofori-Atta’s arrest, the journalist posed several questions to ICE, including:

  1. Whether ICE was currently holding Ken Ofori-Atta
  2. The legal basis for his detention
  3. Whether any judicial process had taken place since his arrest
  4. Whether ICE was aware of a pending extradition request from the Government of Ghana
  5. Whether such a request influenced the detention decision
  6. Whether any public documents relating to the detention were available

In response, ICE provided general information clarifying that the detention was strictly based on immigration violations, not extradition proceedings.

Visa Status Clarified

According to ICE, Ken Ofori-Atta entered the United States on May 28, 2025, using a visitor’s visa that expired on November 27, 2025.

“Kenneth Nana Yaw Ofori-Atta is an illegal alien from Ghana that is facing corruption and corruption-related charges in his home country. He entered the United States on May 28, 2025, on a visitor’s visa with an expiration date of Nov. 27, 2025. Ofori-Atta overstayed his permitted admission,” ICE said.

The immigration authority further indicated that Ofori-Atta will remain in custody as he goes through the due process of U.S. immigration law.

Extradition Still Uncertain

While ICE acknowledged awareness of corruption charges against Ofori-Atta in Ghana, it did not confirm whether there is an active extradition request or whether deportation proceedings would result in his return to Ghana.

For now, the former Finance Minister’s fate remains uncertain as legal processes unfold in both jurisdictions.

The case continues to draw national attention in Ghana, raising critical questions about accountability, political justice, and diplomatic engagement, as well as the broader implications for public trust in governance and the rule of law.
