Ken Ofori-Atta to Appear in US Court: Former Ghanaian Finance Minister Ken Ofori-Atta is expected to appear before a United States court today, Tuesday, January 20, 2026, as part of ongoing immigration proceedings following his recent detention by the United States Immigration and Customs Enforcement (ICE).

The court hearing marks a critical stage in a case that has drawn significant public and political attention in both Ghana and the United States, raising broader questions about immigration compliance, extradition, and ongoing corruption investigations back home.

ICE Detention and Immigration Allegations

Mr Ofori-Atta was taken into custody by ICE after U.S. authorities determined that he no longer held valid immigration status. According to ICE, the former finance minister had overstayed his visitor visa, resulting in the loss of his legal right to remain in the United States.

However, Ghana’s Deputy Attorney-General, Justice Srem Sai, has clarified that the matter goes beyond a simple visa overstay. Speaking on TV3’s Key Points programme, Justice Srem Sai stated that Mr Ofori-Atta’s visa was formally revoked in June 2025, a development that fundamentally altered his immigration status.

“June 2025, his visa was revoked; it’s not an expiration of the visa,” Justice Srem Sai explained. “The information we have is that his visa was revoked. So he has been living in America without a visa.”

This clarification directly contradicts earlier suggestions that the issue was merely administrative or routine.

Ghana–US Law Enforcement Collaboration

Justice Srem Sai further disclosed that Ghanaian authorities have been actively collaborating with U.S. law enforcement agencies in relation to Mr Ofori-Atta’s case.

“We are keenly involved in this matter. We collaborate with law enforcement agencies on this matter,” he stated.

This revelation underscores the seriousness with which the Government of Ghana is treating the case and suggests that the immigration proceedings may be closely linked to broader legal and investigative efforts involving the former minister.

Possible Extradition to Ghana

One of the most significant implications of today’s court appearance is the possibility of extradition to Ghana. Officials have indicated that the outcome of the U.S. proceedings could determine whether Mr Ofori-Atta will be returned to face investigations by Ghanaian authorities.

The former finance minister is wanted by both the Attorney-General’s Department and the Office of the Special Prosecutor (OSP) in connection with alleged financial improprieties. These include investigations linked to the Strategic Mobilisation Limited (SML) deal and the controversial National Cathedral project.

Justice Srem Sai has suggested that Mr Ofori-Atta’s return to Ghana could occur sooner than anticipated.

“Ofori-Atta could be back in Ghana sooner than expected,” he remarked, fuelling speculation that extradition proceedings may already be under consideration.

Legal Team Pushes Back

In response to the detention, Mr Ofori-Atta’s U.S.-based legal team—Menka-Premo, Osei-Bonsu, Bruce-Cathline and Partners—issued a public notice on January 7, 2026, confirming that their client had been detained by ICE but stressing that he is cooperating fully with authorities.

The lawyers argued that Mr Ofori-Atta has a pending petition for adjustment of status, which they say legally permits a person to remain in the United States beyond the validity period of their visa.

“Mr. Ofori-Atta has a pending petition for adjustment of status, which authorises a person to stay in the US legally past the period of validity of their visa,” the statement said. “Under US law, a change of status by this method is common.”

The legal team also described the former minister as a law-abiding individual and expressed confidence that the matter would be resolved through due legal process.

Medical Grounds and Complicated Stay

Mr Ofori-Atta has been in the United States primarily to seek medical treatment for a long-standing illness, a fact that has been cited repeatedly by his lawyers and associates. However, the immigration case has significantly complicated his stay and raised uncertainty about whether he will be allowed to remain in the country pending medical care.

Although his legal representatives have previously indicated that he would return to Ghana when required, recent developments suggest that his return may now be dictated by judicial and immigration outcomes, rather than personal choice.

What to Expect From Today’s Hearing

Today’s court appearance is expected to provide greater clarity on Mr Ofori-Atta’s immigration status, including whether he qualifies for relief under U.S. immigration law or faces deportation.

It may also signal the next steps regarding possible extradition to Ghana, where investigations into his tenure as finance minister remain ongoing.
